RRPEV prides itself on its ability to effectively represent clients in the banking and financial services industry. The financial services industry faces many new challenges and financial institutions must make secure credit extensions, while at the same time dealing with a web of regulations pertaining to a bank’s financial health, protecting consumers and depositors, as well as controlling the flow of monies in and out of financial institutions. Many of these regulations have been enacted rather recently, such as the Patriot Act, and are a reflection of a broader, global movement towards greater governmental scrutiny and control over monetary transactions. In this environment, RRPEV assists its clients in credit extension transactions (i.e., all aspects of commercial lending), regulatory compliance issues, banking law, and secured creditor litigation.

Our experience includes real estate secured lending, including construction lending and loans secured by income producing property, asset based lending, such as asset based revolving credit facilities and other corporate banking transactions, export-import bank loans, factoring arrangements, equipment finance, and trade finance. Our regulatory and banking law practice assists clients in the formation of de novo banking institutions, consumer credit regulatory compliance issues, asset acquisitions and deposit transfers, business combinations involving financial institutions, and compliance issues specific to international banks. Each of these areas is increasing in complexity as new regulations and laws are enacted which re-shape the manner in which banks and financial institutions conduct business in the State of Florida, nationally and internationally.

Our firm is also experienced in assisting bank clients in the collection of distressed assets through legal proceedings, such as foreclosure, or through the negotiation of settlements agreements or “work-outs” of distressed bank assets.
